1. Services

Bates Contracting provides fence, gate, access control, and outdoor structure design, installation, and repair services for residential and commercial customers in Northwest Arkansas. All estimates are provided free of charge and are valid for 30 days unless otherwise stated in writing. Work scope, pricing, and schedule are governed by the signed written agreement for your specific project; if any conflict exists, that agreement controls over these Terms.

2. SMS / Text Messaging Terms

By providing your mobile phone number to Bates Contracting, you consent to receive text messages (SMS/MMS) from us related to your inquiry, estimate, or project. Consent to receive text messages is not a condition of purchasing any goods or services.

• Program description: conversational customer service, estimate follow-up, appointment confirmations, scheduling changes, and project updates.
• Message frequency: message frequency varies and depends on your project and your interaction with us.
• Cost: Message and data rates may apply. Bates Contracting does not charge for these messages; your mobile carrier may.
• Opt out: Reply STOP to any message to cancel. You will receive one final confirmation message and no further messages unless you opt in again.
• Help: Reply HELP for assistance, or contact us at (479) 543-5717 or support@batescontractingnwa.com.
• Carriers: Carriers are not liable for delayed or undelivered messages. Delivery is subject to effective transmission by your carrier.
• Eligibility: You must be 18 or older and the account holder or authorized user of the mobile number you provide.

No mobile information will be sold, rented, or shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. See our Privacy Policy for full details.

3. Estimates, Scheduling, and Payment

• Estimates are based on site conditions observed at the time of the visit. Unforeseen conditions (rock, buried utilities, grade changes, permitting requirements) may require a written change order.
• Schedules are estimates and may shift due to weather, material availability, permitting, or utility locates.
• Payment terms, deposits, and final balance due are set in your project agreement. Late balances may accrue interest as permitted by Arkansas law.
• Customers are responsible for identifying property lines and disclosing HOA or municipal requirements.

4. Warranty

We warrant our workmanship as stated in your written project agreement. Materials carry only the warranty offered by their manufacturer. Warranties do not cover normal weathering of wood, damage from storms, impact, vehicles, animals, improper maintenance, ground movement, or alterations made by others.

5. Website Use

Content on this website, including text, photographs, and design, is owned by Bates Contracting LLC and may not be copied or reused without permission. You agree not to use this website for unlawful purposes or to attempt to interfere with its operation. Site content is provided for informational purposes and does not constitute a binding offer or quote.

6. Limitation of Liability

To the maximum extent permitted by law, Bates Contracting LLC is not liable for indirect, incidental, or consequential damages arising from use of this website or our communications. Our total liability related to any project is limited to the amount paid for that project.

7. Changes to These Terms

We may update these Terms from time to time. Changes take effect when posted, and the “Last updated” date above will be revised. Continued use of our website or services means you accept the updated Terms.

8. Governing Law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law rules. Any dispute will be resolved in the state or federal courts located in Benton County, Arkansas.
