These Terms of Service (“Terms”) govern your use of this website and any communication with Bates Contracting LLC(“Bates Contracting,” “we,” or “us”) through the phone number, email address, or live chat widget published here. By using this site you agree to these Terms. If you do not agree, please do not use the site.

This site is provided for general information about our fencing and gate services in Northwest Arkansas. There are no forms, accounts, calendars, or payment features on this site. You agree not to misuse the site, including attempting to gain unauthorized access, scraping content for resale, interfering with its operation, or using it for unlawful purposes.

4. Estimates, pricing, and services

• Content on this site, including descriptions of materials and services, is informational and is not a binding offer or warranty.
• Prices discussed by phone, email, or chat are preliminary until we provide a written estimate. Written estimates are valid for the period stated on them and may change if site conditions, material costs, footage, or scope change.
• Property lines, easements, setbacks, HOA approval, and permits are the property owner’s responsibility unless we agree in writing to handle them. We will call for public utility locates as required by Arkansas law; private lines such as irrigation, invisible fence, and low-voltage lighting must be marked by the owner.
• Any workmanship warranty is stated in your written estimate or invoice. Manufacturer warranties on materials pass through to you and are not warranties from us.

5. Communications, live chat, and SMS terms

• By calling, texting, emailing, or messaging us through the live chat widget, you agree that we may respond using the same method or the contact details you provide.
• Text messaging. With your consent, we may send customer-care and service text messages about your project — scheduling, estimates, crew arrival, job updates, and billing questions. Consent is not a condition of purchase.
• Message frequency varies. Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
• No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
• Opt out: reply STOP to any text message to stop receiving texts. Reply HELP for assistance, or contact (479) 543-5717 or batescontractingar@gmail.com.
• Do not send emergency requests, sensitive personal information, or payment card details through chat or text. Live chat is monitored during business hours only.
• We do not sell or share your phone number or messaging consent with third parties or affiliates for their marketing purposes. See our Privacy Policy.

The live chat widget on this site is provided by LeadConnector/HighLevel, Inc. and is subject to that provider’s terms and privacy practices in addition to ours. We are not responsible for third-party services, websites, or content we do not control.

7. Intellectual property

The text, layout, images, and branding on this site are owned by Bates Contracting LLC or used with permission. You may not reproduce, republish, or use them commercially without our written permission.

8. Disclaimers and limitation of liability

This site is provided “as is” without warranties of any kind, express or implied, including accuracy, availability, or fitness for a particular purpose. To the fullest extent permitted by law, Bates Contracting LLC is not liable for indirect, incidental, consequential, or punitive damages arising from your use of this site or reliance on its content. These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Washington County, Arkansas.
